Commonwealth Court invalidates portions of Gov. Wolf’s direct care worker executive order

The Commonwealth Court on Thursday issued an opinion invalidating portions of a February 27, 2015, executive order issued by Gov. Tom Wolf that would—among other things—allow direct care workers to organize in a way to bargain its rights with the Commonwealth and create a list to solicit membership in a collective organization of direct care workers who would be represented by a single representative before the Commonwealth.

The executive order was issued in 2015 as part of a pre-budget address launch of a number of initiatives of the governor and his administration to “improve home and community-based care for seniors in Pennsylvania.”
